TERMS AND CONDITIONS

THE TERMS & CONDITIONS CONSTITUTE PART OF CLIENT CONTRACT FOR TRIP AND ANY RELATED SERVICES.

PLEASE READ – CONTRACTUAL NOTICE

This document constitutes part of your contract for your trip and any related services with WE Luxe Travel (also known as West Essex Luxe Travel). Please review these terms and conditions carefully. If you have any questions, contact us immediately.

The addressee of this notice is the sole recipient of the booking receipt and terms and conditions, and is fully responsible for informing all other traveling parties of this content. By accepting this receipt and making payment to WE Luxe Travel, the booking passenger acknowledges that they have reviewed, understood, and accepted these terms and conditions, which form the contract for all travel-related services.


By booking any trip, making payment, or otherwise engaging WE Luxe Travel’s services, you acknowledge and agree to be automatically bound by these Terms and Conditions, as updated and published at the time of your booking, without further signature or separate acknowledgment required. Your continued use of WE Luxe Travel services constitutes your acceptance of all applicable terms.


If you do not accept these terms and conditions, you must notify WE Luxe Travel in writing prior to making payment or confirming your booking. Use of our services after this time constitutes automatic acceptance of all applicable terms.


Booking Accuracy / Legal Names

Passengers must promptly review all booking details—including legal names, mailing and email addresses, phone numbers, birth dates, pricing, airfare, airports, accommodations, and organized activities—as they appear on your receipt. Notify WE Luxe Travel immediately about any errors or omissions. Passengers assume full responsibility for any risks, costs, or losses resulting from failing to report necessary corrections before travel documents are issued. It is the passenger’s obligation to ensure that all names on travel documents exactly match the legal first and last names on their passport or government-issued ID.


TRAVEL DOCUMENTS

ALL INTERNATIONAL TRAVEL REQUIRES A PASSPORT
All international travel requires a valid passport. Passenger(s) assume sole responsibility to independently research and confirm all documentation requirements for their specific destinations, including but not limited to passports, visas, vaccinations, health paperwork, and any new requirements such as Electronic Travel Authorization (ETA), European Travel Information and Authorization System (ETIAS), or REAL ID for domestic U.S. travel as of 2025. Passengers must ensure that all documents, validity periods, and required forms are secured and available at all times during travel.

WE Luxe Travel may provide general reminders or direct clients to official government resources, but the agency does not guarantee the accuracy or completeness of information and assumes no liability for loss, denial of entry, delay, or expense resulting from the client’s failure to have proper documentation. All travel costs lost due to documentation issues are strictly nonrefundable. Travelers are strongly encouraged to consult with appropriate domestic and foreign agencies for the most current entry, exit, and health requirements.


Passport Expiration Dates

Many countries require that a traveler’s passport be valid for at least six (6) months beyond the date of return to the United States or home country. It is the sole responsibility of each passenger to check and ensure that their passport meets the required validity period for every destination on their itinerary. WE Luxe Travel is not responsible for denied boarding, entry, or additional travel costs incurred due to insufficient passport validity or expiration. Passengers are strongly advised to confirm destination-specific requirements with the appropriate embassy or government agency before travel.


Visa Requirements

Passengers are solely responsible for determining and obtaining all necessary visas, permits, and travel authorizations required for each destination included in their itinerary, including any layovers or transit countries. Requirements may vary by destination, nationality, purpose of travel, and recent government regulations. WE Luxe Travel provides general guidance but does not guarantee the completeness or accuracy of visa information. Failure to secure the appropriate visas may result in denied boarding, entry, or additional costs for which WE Luxe Travel assumes no liability. Passengers are strongly advised to consult embassies or official government websites for the most current entry and visa regulations prior to travel.


Payments by Credit Card

WE Luxe Travel accepts Visa, American Express, Discover, and Mastercard. Reservations are held until the “Deposit Due Date” on your confirmation. If payment is not received by WE Luxe Travel on or before the Deposit Due Date, your reservation will be automatically cancelled. Failure to remit payments on time puts your entire booking at risk of cancellation. Passengers voluntarily hold WE Luxe Travel harmless for cancellation of any booking resulting from late payment or credit card declinations.

It is the traveler’s sole responsibility to note all final payment dates and submit payment on time. While the agency may attempt reminders as a courtesy, WE Luxe Travel is not liable if travelers miss, overlook, or fail to respond to payment deadline communications. Suppliers may have cut-off deadlines as early as 5 p.m., 9 p.m., or midnight in their respective time zones. It is the traveler’s responsibility to confirm and meet these deadlines. Any cancellation or additional costs due to missed payments are the traveler’s responsibility.


Credit Card Processing Fees

A credit card processing fee may be applied to any payments made by credit card. This non-refundable fee is intended to cover costs incurred from payment processors, and typically ranges from 1.5% to 4% of the total transaction amount, depending on the card type, payment method, and location of the traveler and agency. If a processing fee applies, WE Luxe Travel will clearly disclose this to the client prior to payment being made. Any international or cross-border payments may be subject to additional transaction or currency conversion fees assessed by the traveler’s own bank or credit card issuer for which WE Luxe Travel is not responsible


WIRE TRANSFER PAYMENTS & FRAUD PREVENTION

By choosing to pay any supplier, service provider, or third party by wire transfer:

  • WE Luxe Travel acts solely as an intermediary and is not responsible for payment transactions made directly between you and the supplier.
  • You are solely responsible for verifying the legitimacy of the supplier’s payment instructions through direct, secure, and vetted communication.
  • WE Luxe Travel will never change payment instructions via email. If you receive new or altered payment instructions, you must contact WE Luxe Travel at a known, trusted phone number before initiating payment.
  • In the event of loss due to fraud (including but not limited to phishing, hacked email, spoofed payment requests, or misdirected funds), you agree to hold WE Luxe Travel harmless; WE Luxe Travel cannot retrieve funds or provide compensation for payments made to fraudulent accounts.
  • Once funds are wired, the transaction is typically irreversible. Any recourse for non-fulfillment is solely with the supplier.
  • WE Luxe Travel strongly encourages payment via secure methods and recommends verifying all wire details via a second channel, such as a direct phone call.


Except in cases of proven fraud or non-delivery of contracted travel services, you agree not to file a payment dispute or chargeback with your bank or credit card company to circumvent the booking terms and conditions of WE Luxe Travel or its suppliers, including for cancellations, itinerary changes, or arrangements impacted by matters beyond the control of WE Luxe Travel or its suppliers. If you initiate or attempt to reverse a previously authorized payment in violation of these terms, WE Luxe Travel reserves the right to recover all associated costs, fees, expenses, and attorney fees incurred as a result of such chargeback, reversal, or recollection.


INDIVIDUAL ENTRY AND EXIT REQUIREMENTS

Each country holds different views of past criminal offenses, whether within or outside of their boundaries. If you have a current or prior criminal offense, contact that country directly for entry and exit requirements. You can visit the US State Department Website for further information about these requirements. See, https://travel.state.gov/content/travel.html. We do not inquire about an individual’s criminal record in the interest of respecting our Clients’ privacy. For example, if traveling to or through Canada, individuals with a Driving While Intoxicated (DWI) record should review current entry requirements. See, http://www.cic.gc.ca/english/information/faq/inadmissibility/index.asp.


HEALTH IMMUNIZATIONS

You must have the proper immunizations and health screenings and required documentation of such immunizations and screenings before travel. WE Luxe Travel shall not assume responsibility for the accuracy of health, vaccination, or documentation prior to departure or upon landing at the final destination. In some cases, required inoculations must be recorded by Client’s health practitioner on a valid vaccination certificate, which the Client must carry for proof of inoculation. If you are concerned about taking any medications or receiving certain inoculations, check with your health practitioner BEFORE booking. Check the State Department Web site http://travel.state.gov, for relevant information relating to travel to specific destinations, and the Center for Disease Control http://wwwnc.cdc.gov/travel/ relating to health issues related to travel.  This includes but is not limited to Covid-19 Vaccinations and boosters that may be required for entry into certain destinations. 


AIRLINE RESERVATIONS

 UNLESS SET FORTH IN WRITING, AIRLINE RESERVATIONS ARE NOT INCLUDED IN YOUR TRAVEL PLANS. In such event, it is the Client’s responsibility to make appropriate air arrangements, as well as transportation to and from the destination where the travel booking originates and returns. WE Luxe Travel shall not assume any responsibility for any air and/or ground schedule changes. In rare instances, upon departure from a country, certain departure taxes must be paid in cash only, and may vary in price. Failure to use a reservation may result in automatic cancellation of all continuing and return flights, as well as forfeiture of airfares.

Airline e-tickets expire a year from issue date unless carrier fare rules in passenger’s itinerary fare provide otherwise.


PRICING

Prices and availability quoted by WE Luxe Travel are not guaranteed until deposit is fully paid. Pricing and availability may change without notice. Passenger agrees that WE Luxe Travel is not responsible for any errors or omissions in any quotes, advertisements, including on our website, resulting in inventory, content, or pricing discrepancies nor is WE Luxe Travel responsible for any errors or omissions that may occur as a result of incorrect information from third parties. Suppliers reserve the right not to honor any published prices that it determines were erroneous due to electronic, printing, or clerical error. You acknowledge this right and agree to hold WE Luxe Travel harmless for any actions or damages arising from Supplier pricing.


Dynamic Pricing & Currency Clause
All prices are subject to change based on currency exchange rate fluctuations, new or increased taxes, fuel or energy surcharges, or supplier-imposed increases, until full payment is received. WE Luxe Travel is not liable for additional costs due to price changes after booking but prior to final payment.


Supplier Refund Handling

Any refunds for third-party supplier charges (including but not limited to airfare, hotels, or tours) must be requested directly from the applicable supplier and will be issued, if approved, directly to the client by the supplier in accordance with their specific refund policy and timeline. WE Luxe Travel is not responsible for the timing, denial, amount, or method of any supplier refund. The agency does not intermediate, expedite, or guarantee supplier refunds, nor does it assume any liability for supplier nonpayment or disputes.


Additional Taxes and Governmental Fees

WE Luxe Travel is not responsible for any new or increased taxes, fees, surcharges, or other additional costs imposed by governments, authorities, or suppliers after your booking is made. Any such charges—whether related to accommodations, airfare, transportation, or other travel services—are the responsibility of the traveler and must be paid as required, even if implemented after your reservation is confirmed. These fees are not reimbursable by WE Luxe Travel.


AIRFARE

a. General Conditions Governing Air Transport

Airline tickets are highly restrictive, non-refundable, and non-transferable. Modification of passenger names, dates, times, routings, or departure/arrival airports is at the sole discretion of the airline and, if permitted, will likely be subject to a substantial change fee.  Passenger is responsible for any such fees. With regard to the purchase of air tickets, WE Luxe Travel acts simply as an intermediary between you and the airline. Once you book a reservation, your credit card or debit card will be charged for the amount shown – regardless of whether or not the reservation is used. Credit will not be given for any unused airline tickets and cannot be used toward any future bookings.

Seat assignments are subject to the airlines policies and may not be able to be made until you are at the airport on the day of departure.  Airline tickets booked through WE Luxe Travel may or may not not eligible to earn frequent flyer miles. You agree to confirm all bookings with the airline prior to the stated date of departure (WE Luxe Travel recommends confirming 72 hours prior).

WE Luxe Travel’s responsibilities in respect to air travel are limited by the relevant airline’s conditions of carriage.  The airline fulfilling your contract for carriage may change from the airline mentioned by WE Luxe Travel. WE Luxe Travel is not able to specify the type of aircraft to be used by any airline. WE Luxe Travel will not provide any refund for Trips missed, in part or full.

b. Luggage

Each airline has its own policy regarding luggage.  We recommend that you check with your airline ahead of time for any weight restrictions and additional charges relating to checked baggage. You will be responsible for paying to the airline any additional charges for checked or overweight baggage, including, but not limited to, golf bags and oversized luggage.  If you exceed the weight limit set by your airline, and excess weight is permitted, you must pay a supplement directly to the airline at the airport.

The airline is liable to you for the baggage you entrust to it only for the compensation contemplated in the international conventions and relevant statutes.  In the event of damage, late forwarding, theft or loss of luggage, you should contact the your airline and declare the damage, absence or loss of your personal effects before leaving the airport, and then submit a declaration, attaching the originals of the following documents: the travel ticket, the baggage check-in slip, and the declaration.  WE Luxe Travel strongly recommends that you obtain a travel insurance policy covering the value of your items.

c. Limitation of Liability for Air Transport

IN ADDITION TO THE LIMITATIONS OF LIABILITY SET FORTH ABOVE, YOU AGREE THAT WE LUXE TRAVEL IS NOT LIABLE  FOR ANY DAMAGES ARISING FROM OR RELATED TO ANY AIRLINE TIMETABLE CHANGES, DELAYS, CANCELLATIONS, MISSED CONNECTIONS, MECHANICAL PROBLEMS, INCLEMENT WEATHER, SEATING REASSIGNMENTS, LOST/DELAYED BAGGAGE, SCREENING AND SECURITY DELAYS, REFUSED BOARDING OR FAILURE TO CHECK-IN PROPERLY.


ACCOMMODATIONS AND ACTIVITIES

Accommodations refers to all lodging types provided to travelers, including hotels, condos, cruise quarters, motels, time shares, campgrounds, and resorts.

  • Classification: Star ratings reflect local standards and may vary by country. WE Luxe Travel cannot guarantee accommodation availability, suitability, or that classification/comments match expectations. If a selected accommodation is unavailable, WE Luxe Travel will seek comparable alternatives, with any price difference at the traveler’s expense. Substitutions due to force majeure or third-party issues are rare but may occur.
  • Check-in/Check-out: Policies differ by establishment and destination; guests are responsible for confirming times and terms directly. WE Luxe Travel is not liable for costs from failure to observe property policies.
  • Room Descriptions: Photos and descriptions are for reference only; specific features are not guaranteed.
  • Meal Plans: Offerings depend on the plan chosen (e.g., all-inclusive, full board, half board). Inclusions and exclusions are clearly stated at booking.
  • Activities: Availability depends on occupancy, weather, season, or minimum numbers. Some may be withdrawn, and WE Luxe Travel is not liable for cancellations or for any incident arising from client inattention or health conditions. Some activities are provided by third parties, and related costs or liability rest with the participant.


GRATUITIES/ADDITIONAL FEES

Wherever possible, the travel agent will attempt to inform the client of any additional costs such as hotel taxes payable upon check in or resort fees.  Hotel taxes may appear on travel vouchers at time of confirmation, and are not always able to be shown during the initial quote.   

The travel agent is not responsible for any omissions of additional fees during the quote process.  These types of fees include:

  • Gratuities to guides, hotel staff, or drivers 
  • Mandatory onboard service charges/gratuities for cruises 
  • City taxes payable directly at the hotel (very common in Europe)
  • Costs for transport to/from the airport if traveler did not include transfers in quote 
  • Breakfasts or other meals at hotels unless they are specifically included in quote 

Travel agent is not responsible for any increases due to fuel surcharges, government imposed taxes/fees or supplier-imposed increases.


Automated & Digital Notifications
By booking with WE Luxe Travel, you expressly consent to receive booking updates, changes, and legally-required notices through email, SMS, or secure platforms, including automated notifications about your itinerary and policy changes.


CANCELLATION POLICIES

All cancellations or no-shows are subject to penalties imposed by the supplier. If you require a copy of these terms, please contact the supplier or your agent at WE Luxe Travel. 

Cancellation Policy
All cancellations MUST be submitted in writing and sent to WE Luxe Travel by email at the address specified by the agency. Cancellations sent to any other address, or by other means, will not be processed. Upon requesting a cancellation, the client must also complete and sign the official WE Luxe Travel cancellation form. No cancellation will be processed or considered effective until this signed form is received. Clients are responsible for ensuring all documentation is properly submitted.

Cancellations are posted on the day that the complete cancellation documents (including the signed cancellation form) are received by WE Luxe Travel, so long as they are received before 5:00 p.m. Eastern Time on a business day. All other cancellations will be processed on the next business day. For example, if the email and signed form are received after 5:00 p.m. or on a non-business day, processing will occur on the following business day. Confirmation of cancellation will be provided by email when processed.

WE Luxe Cancellation Fee
WE Luxe Travel reserves the right to charge a cancellation fee of up to 15% of your booking cost, separate and apart from any supplier-imposed fees. Clients acknowledge and accept responsibility for all cancellation fees imposed by WE Luxe Travel and suppliers. This fee is non-refundable and will be charged prior to processing any cancellation. Clients may submit this fee to their travel insurance provider for potential reimbursement.


TRAVEL PROTECTION

Travel insurance protection is Strongly Recommended. 

WE Luxe Travel provides a general recommendation that clients consider purchasing travel insurance but is not responsible for automatically quoting, offering, or arranging insurance for every individual trip. It is the sole responsibility of the traveler to research, obtain, and verify their chosen policy, coverage, and provider. WE Luxe Travel will not be held liable for any client’s decision to travel without adequate insurance coverage or for any denial of insurance claims. 

While we do offer coverage through certain carriers, we cannot compare all the policies or companies currently in the marketplace. This responsibility rests solely with you the customer and we advise you to do your research and find coverage that best fits your individual needs. WE Luxe Travel is limited to advising you of the need for such coverage. 

By declining travel protection, you acknowledge and accept liability for any cancellation penalties, damages and/or out–of-pocket expenses incurred.  You also acknowledge and accept responsibility for arranging and paying for any treatment in case of a medical emergency while traveling. Please note that if you decline this type of coverage, you have waived your right to this important coverage and your confirmation will note “declined” next to the travel protection section of your confirmation. 

Insurance Waiver Non-Signature:
Failure or refusal by the client to sign an insurance waiver—whether acknowledging the offer or declining travel insurance—shall not be construed to create any liability on the part of WE Luxe Travel. The agency’s recommendation of travel insurance and all other limitations of responsibility remain fully in force, regardless of whether the client provides written acknowledgment or signature of an insurance waiver.

WE Luxe Travel does not have access to, nor will inquire about, clients’ personal medical histories or pre-existing conditions. Failure to obtain coverage within insurer-required time windows may result in exclusion of pre-existing conditions from your policy. WE Luxe Travel will not be liable for any denial of claims or uncovered expenses related to undisclosed or unprotected medical conditions.

Travel  Insurance is not included unless specified. Clients who decline coverage accept responsibility for all cancellation penalties, unexpected medical, quarantine, and trip interruption costs. Insurance coverage must be researched and purchased independently; the agent is not liable for denied claims or policy coverage disputes

We urge you to read your policy when it arrives as it contains important information. This information includes, but is not limited to, details on the extent of coverage and procedures for making a claim.

All requests for service under the policy must be filed directly with the travel insurance provider, in accordance with the policy terms and conditions, which you the passenger are responsible for reviewing upon receipt of your travel protection policy. WE Luxe Travel is not able to give advice with regard to possible cancellations and any associated claims processing. All queries regarding cancellation, penalties, coverage should be directed to your particular travel insurance provider.  Please note that the travel insurance provider may not be allowed to discuss your claim with WE Luxe Travel due to privacy laws (e.g. HIPAA). Accordingly, you acknowledge that WE Luxe Travel cannot be involved in any aspect of your claim/request for service. Passenger(s) acknowledge and agree that WE Luxe Travel has no control over the travel insurance provider or its coverage decisions, and as a result WE Luxe Travel is not responsible for and shall not be liable for policy coverage, claims processing, or the denial of any claims.


AGENT/INTERMEDIARY

WE Luxe Travel is simply an intermediary between the Suppliers and the public. WE Luxe Travel does not own or operate any of, hotels, shore excursions, tours, transportation providers, cruise lines, vessels, airlines,  travel protection companies, attractions, or other travel-related Suppliers who provide goods or services for the Passenger(s)’ trip. Passenger(s) acknowledge and agree that WE Luxe Travel shall not be responsible for any loss, damage, delay, inconvenience or injury to Passenger(s) or group members as a result of a breach of contract, act or omission whether willful or negligent, criminal or otherwise of any person other than WE Luxe Travel or its direct employees, including but not limited to these Suppliers, their employees, agents, servants, or representatives.

Suppliers reserve the right to deviate from the direct, customary and/or scheduled route or itinerary for any reason, without limitation and without notice. Passenger(s) acknowledge and agree that WE Luxe Travel is not responsible for Supplier deviations, delays, cancellations, mandated overnight stays, missed connections or any other condition beyond its control.  WE Luxe Travel is not liable for any loss due to Passenger’s gambling and is not responsible for any purchases made while on the trip.

WE Luxe Travel recommends that all Passengers be in good physical and mental health and have medical approval to travel. Any physical disabilities must be reported to WE Luxe Travel at the time of reservation upon initial booking so WE Luxe Travel can contact the Suppliers to investigate amenities and/or special accommodations offered.  Passenger is required to provide his or her own personal or individually prescribed devices such as wheelchairs, walkers, or similar devices. If more than minor assistance is needed, Suppliers may require that the Passenger be accompanied by a companion who is capable of, and responsible for, providing such assistance. Suppliers often reserve the right to reject Passengers whose mental or physical condition may interfere with the itinerary. Passenger(s) acknowledge and agree that WE Luxe Travel shall be held harmless for any and all claims relating to Supplier rejection relating to mental or physical condition.

While WE Luxe Travel prides itself on selecting top quality Suppliers, no undertaking, guarantee or warranty is given or shall be implied as to the fitness or condition of the Supplier’s accommodations, transportation, or any food, drink, medicine, or provisions supplied.  Passenger(s) acknowledge and agree that WE Luxe Travel shall not be responsible for refunding, either fully or partially, any amounts paid due to unsatisfactory services from any supplier. In no event shall WE Luxe Travel be liable for any accident which occurs in hotels, in resorts, on airplanes/in airports, on buses/in bus stations, on trains/in train stations, on board a cruise ship, on tenders, on shore excursions, or during any mode of transportation encountered during the trip, resulting from equipment or any other cause. The Passenger admits a full understanding of the nature and character of the mode of transport and assumes all risks of travel, transportation and handling of passengers and baggage.


Third-Party Supplier Liability
WE Luxe Travel is not liable for the acts, errors, omissions, delays, defaults, or failures of any third-party travel supplier. Any recovery for non-performance or unsatisfactory service must be sought directly from the supplier, consistent with their own terms and conditions.


Independent Contractor Status

Where applicable, advisors, consultants, or other providers supplying services through WE Luxe Travel do so strictly as independent contractors and not as employees, agents, or legal representatives of WE Luxe Travel. Independent contractors operate their own businesses, set their own schedules, and may provide services to other agencies or clients. WE Luxe Travel does not supervise, direct, control, or assume liability for the actions, omissions, work product, advice, or representations of these independent contractors, except as expressly required by law.

WE Luxe Travel shall not be liable for any loss, damage, claim, or expense arising from the conduct, non-performance, or negligence of any independent contractor. Independent contractors are solely responsible for their compliance with licensing, insurance, legal, and financial obligations, and for the payment of all applicable taxes. The client acknowledges that any dispute or claim regarding services or conduct by an independent contractor should be addressed directly with that individual or entity.


Force Majeure:
WE Luxe Travel shall not be in breach of these terms and conditions, nor otherwise liable to the client, for any failure or delay in performing obligations under this Agreement due to causes beyond its reasonable control, including but not limited to: acts of God, natural disasters, accidents, riots, war, acts of terrorism, epidemic, pandemic, quarantine, civil unrest, breakdown of communication facilities or equipment, government action or omission, regulatory changes, fire, explosion, strikes, labor disputes, cybersecurity incidents or system outages, supply chain disruptions, shortages, extreme weather, and any other unforeseen circumstance (“Force Majeure Event”).

Each of WE Luxe Travel’s suppliers also maintains terms and conditions that govern your trip. If an affected supplier declares a Force Majeure Event, that supplier has sole discretion to vary, reschedule, or cancel any part of your itinerary or arrangements. Any refund or compensation is at the sole discretion of the supplier, and WE Luxe Travel will use reasonable efforts to secure any available reimbursement on your behalf. WE Luxe Travel is not liable for any failure, delay, or changes in service caused by a Force Majeure Event.

If a Force Majeure Event prevents performance under this agreement for a continuing period of more than [a defined period, e.g., 60 days], either party may terminate the affected parts of this agreement without further liability (except for obligations already incurred).

Travel insurance is highly recommended for all trips.


Client Conduct

Each participant in any trip arranged or escorted by WE Luxe Travel is expected to act responsibly and respectfully, and to follow all behavior guidelines established by WE Luxe Travel and its suppliers. WE Luxe Travel and all local suppliers reserve the right, at their sole discretion, to remove any individual from any facility, hotel or resort property, tour location, or means of transportation if that person’s health, actions, or conduct is determined to endanger themselves or others, disrupt the well-being of other clients, or interfere with the operation or security of the trip. In such cases, no refund will be provided.

By booking with WE Luxe Travel, clients accept financial responsibility for any damage or loss they cause. Full payment for any such damage or loss (reasonably estimated if not precisely known) must be paid directly at the time to the accommodation owner, manager, or other supplier. Clients agree to indemnify WE Luxe Travel for the full amount of any claim (including legal costs) made against the agency resulting from their actions. The agency assumes no responsibility for any costs relating to a guest removed from a trip for conduct reasons, nor for any portion of a trip missed due to such removal. Baggage and personal effects are always the sole responsibility of the participant.


Travelers’ Responsibility to Communicate:

The travel agent is not liable for any errors or omis​​sions arising from travelers’ significant delay in responding to requests for necessary information including but not limited to:

  • Airline schedule needed to book appropriate transfers
  • Payment deadlines
  • Customized suggestions for excursions or inquiries if services are needed​

The travel agent reserves the right to decline to book optional services when information is not received in a timely manner. 


Group Bookings

  • When travelers do not live at the same address,  the travel agent will correspond with the initial group leader (the person who made the first contact) throughout the quote process. 
  • The group leader will be responsible for communicating the details of the quote and/or any agent questions to the rest of the group. 
  • The travel agent is not responsible for any dissatisfaction with the itinerary by group members: the group leader accepts responsibility for checking the itinerary.  By agreeing to move forward with the deposits, the group leader acknowledges that all parties have been informed of necessary details. 


Limitations for Concierge and Optional Services

WE Luxe Travel is not responsible or liable for any bookings or reservations made directly by the client with any resort, hotel, tour operator, cruise line, or other third-party supplier, including (but not limited to) dining reservations, concierge requests, room or seat upgrades, independently booked tours, or private guides. While WE Luxe Travel may, as a courtesy, provide restaurant recommendations or assist with limited arrangements for special events, it is not WE Luxe Travel’s responsibility to assist in amending or canceling such reservations once booked. WE Luxe Travel will not be liable for any cancellation fees, expenses, losses, or delays arising from the client’s failure to make changes or cancellations directly with the supplier.


CURRENCY FLUCTUATIONS

Currency Fluctuations & Foreign Exchange Rates:
Prices for travel services quoted in foreign currencies are subject to fluctuations in exchange rates beyond the control of WE Luxe Travel. Final pricing may be adjusted to reflect adverse changes in foreign currency values between the time of booking and payment. The agency is not responsible for any increase in costs or differences in amounts due to currency conversion at the time of payment, or for any fees assessed by banks or credit card issuers for foreign transactions.


RIGHT TO CORRECT ERRORS

We reserve the right to correct errors. In the event of any pricing error or omission, we reserve the right to adjust such pricing or make any other corrections. All offers, incentives and Supplier promotions are subject to availability and may change without notice. Prospective Clients are advised to reserve early to avoid disappointment and additional late booking fees.


Data Privacy & Communications Consent
By booking with WE Luxe Travel, you consent to the collection, storage, and use of your personal data for travel arrangement purposes, and for communication with third-party suppliers as needed to deliver contracted services. WE Luxe Travel complies with applicable data protection laws (including GDPR, where relevant). You further consent to receive electronic communications, contract documents, confirmations, and updates via email, SMS, or digital platforms, and agree that digital signatures shall have the same legal effect as handwritten signatures.


LIMITATION OF LIABILITY

Without limitation, Passenger(s) assume the risk of, and agree that WE Luxe Travel is not liable for any damages arising from or related to any act of God or public enemies, arrest, restraints of any government or rulers of people, piracy, war, revolution, extortion, terrorist activity, threatened or actual rebellion, political upheaval, civil unrest, riots, fire, lockouts, explosion, collision, weather conditions, dangers incident to the sea, mechanical or construction failures or difficulties, diseases, local laws, abnormal conditions or developments, closure of airports/seaports/hotels/train stations, carrier or supplier logistical problems, computer problems stranding, food or water poisoning, illness, grounding, perils of the sea, rivers, canals, locks or other waters, perils of navigation of any kind, theft, accident to or from machinery, boilers, or latent defects even though existing at commencement of the trip, desertion or revolt of crew, or lost/damaged/delayed luggage.


To the fullest extent permitted by law, WE Luxe Travel, its officers, agents, and employees, shall not be liable for any loss, injury, claim, damage, delay, expense, or inconvenience arising from (a) the acts, errors, omissions, representations, warranties, breaches, or negligence of any supplier or third-party service provider; (b) any force majeure events; or (c) any event, condition, or circumstance beyond WE Luxe Travel’s direct control. WE Luxe Travel acts solely as a travel advisor and intermediary, not as a provider of travel services. In the event of a supplier’s failure or non-performance, client’s remedy lies solely with the supplier, not with WE Luxe Travel. In all cases, the maximum aggregate liability of WE Luxe Travel for any reason shall not exceed the amount of fees actually received by WE Luxe Travel for the client’s booking.


MODIFICATION OF TERMS AND CONDITIONS

 The Terms and Conditions may be amended or modified by WE Luxe Travel at any time without notice.  It is therefore essential that you consult the Terms and Conditions prior to making each and every booking, particularly in order to ensure what provisions are in operation in case they have changed since the last time an order was placed by you.

Only those who have accepted the Terms and Conditions and affirmatively indicated their consent to be bound by the Terms and Conditions may make a booking with WE Luxe Travel.  Without this acceptance any order is subject to cancellation at any time.

The failure of WE Luxe Travel to act with respect to a breach of these Terms and Conditions by you, or others, does not waive its right to act with respect to subsequent or similar breaches. WE Luxe Travel does not guarantee it will take action against all breaches of this these Terms and Conditions.


SEVERABILITY:  If any provision of this agreement shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this agreement and shall not affect the validity and enforceability of any remaining provisions.

HEADINGS:  Headings are for reference purposes only and do not limit the scope or extent of such section.

Forum Selection Clause

Governing Law and Jurisdiction. This Agreement shall be governed by, and construed in accordance with, the laws of the State of New Jersey, without regard to its conflicts of law principles.

Exclusive Jurisdiction and Venue. The parties agree that any legal action or proceeding arising out of or relating to this Agreement shall be brought exclusively in the state or federal courts located in Essex County, New Jersey. Each party irrevocably submits to the exclusive jurisdiction of such courts in any such action or proceeding and waives any objection to venue laid therein or any claim that such forum is inconvenient.

Waiver of Objections. The parties hereby waive any right to assert, by way of motion, as a defense, or otherwise, in any such suit, action, or proceeding, any claim that they are not personally subject to the jurisdiction of the aforementioned courts, that the suit, action, or proceeding is brought in an inconvenient forum, that the venue of the suit, action, or proceeding is improper, or that this Agreement or the subject matter hereof may not be enforced in or by such court.


SPECIAL TERMS RELATING TO 2019 NOVEL CORONAVIRUS (COVID-19 "CORONAVIRUS") 

Coronavirus COVID-19 Release, Assumption of Risk, Waiver of Liability,  Indemnity Agreement & Agreement to Terms and Conditions  COVID-19 Assumption of Risk, Release, and Indemnification

The client acknowledges the ongoing risks of COVID-19 and understands that all travel arrangements are subject to rapidly changing protocols, government mandates, and the risk of illness, cancellation, delay, or financial loss. The client is solely responsible for reviewing and complying with all health and travel advisories, including those from the CDC, and is aware that disruptions, additional expenses, health screenings, quarantine, denial of boarding, and other unpredictable events may occur.

Travel insurance is strongly recommended, and the client understands coverage for COVID-19 is subject to each insurer’s terms—most not covering known events, epidemics, or pandemic-related disruptions. WE Luxe Travel LLC is not liable for any denied claims, insufficient coverage, or the client’s decision to forgo travel insurance.

The client agrees to hold WE Luxe Travel LLC harmless for any illness, injury, financial loss, penalties, quarantine, or inconvenience relating to COVID-19, including any changes, cancellations, or non-performance by suppliers or authorities. The client will not file chargebacks for such issues. The client assumes all risk and agrees that these terms are binding upon all travelers listed on the booking.
